This Privacy Policy describes how Deshana Enterprises Private Limited (“Company,” “We,” “Us,” or “Our”) collects, uses, stores, and protects information obtained through the use of our Services at smsdekho.com and deshanait.com (collectively, the “Platform”). By accessing or using the Platform, you acknowledge that you have read and understood this Policy in its entirety and consent to the practices described herein. This Policy is incorporated into, and forms part of, our Terms and Conditions of Use.

• "Client" means any business entity or individual that uses the Services under a commercial arrangement with SMS Dekho.

• "User" means an employee, agent, or representative of a Client who accesses the restricted areas of the Platform.
• "Visitor" means any individual who accesses the public-facing areas of the Platform without logging in.
• "Public Area" means the areas of the Platform accessible without login.
• "Restricted Area" means areas of the Platform accessible only to authenticated Users.

2. Personal Information We Collect

SMS Dekho collects information through a variety of means in the course of providing the Services. The legal bases for processing Personal Data include necessity for the performance of a contract, compliance with legal obligations, pursuit of SMS Dekho’s legitimate business interests, and, where required, your express consent.

2.1 Information You Provide

When you register, subscribe, or interact with the Services, you may provide Personal Data including your name, email address, mobile phone number, company name, billing information, and related details. You may also submit information when posting Client Data, using messaging features, or contacting our support team.

2.2 Automatically Collected Information

When you access or use the Platform, we may automatically collect technical information from your device, including IP addresses, device identifiers, browser type and version, operating system, referring URLs, pages visited, and timestamps of access. This data is collected via cookies, pixel tags, web beacons, and similar tracking technologies. We also track interactions with email communications we send, such as open rates and click-through activity.

2.3 Information from Integrated Services

If you choose to connect third-party services or platforms (each, an “Integrated Service”) with your SMS Dekho account, we may receive certain information from those services, including your name, email address, and profile data, to the extent permitted by your privacy settings on those platforms. You are responsible for reviewing the terms and privacy policies of any Integrated Service prior to authorising such a connection.

2.4 Information from Third-Party Sources

We may receive information from business partners, advertisers, and other third-party sources. Where such information is combined with Personal Data collected through the Services, we will treat the aggregate as Personal Data under this Policy.

3. How We Use Your Information

3.1 Service Operations

We use collected information to operate, maintain, administer, and improve the Services; to process transactions; to respond to inquiries and provide customer support; and to ensure the security and integrity of the Platform.

3.2 Analytics and Improvements

We use usage data, analytics, and feedback to understand how Users interact with the Services, identify areas for improvement, and develop new features and products.

3.3 Communications — Including DND Override

Where you have voluntarily submitted your contact information — including but not limited to creating an account, completing any inquiry, contact, or registration form on the Platform, subscribing to our newsletter, or otherwise opting in through any channel — SMS Dekho is entitled to use such information to communicate with you via SMS, voice calls, email, and WhatsApp for the following purposes:

• Account authentication, onboarding, and transactional notifications.
• Service updates, policy changes, maintenance notices, and operational communications.
• Promotional campaigns, offers, and marketing communications relating to SMS Dekho and its affiliated services.
• Customer success, feedback collection, and relationship management.

By voluntarily providing your contact information through any of the above channels, you expressly grant SMS Dekho your informed, affirmative consent to send the above categories of communications, including to mobile numbers that may be enrolled on the Do Not Disturb (DND) or National Customer Preference Register (NCPR) maintained by the Telecom Regulatory Authority of India (TRAI). Such consent constitutes a valid and lawful basis for communication under applicable TRAI regulations and the Information Technology Act, 2000, and shall persist unless and until lawfully withdrawn in accordance with Section 3.4 of this Policy.

Your act of submitting contact information through our Platform — including form submissions and newsletter subscriptions — constitutes explicit opt-in consent, enabling us to contact you even if your number is on the DND registry, to the extent permitted by applicable law.

3.4 Withdrawal of Marketing Consent

You may withdraw your consent to receive marketing and promotional communications at any time by sending a written request to sales@smsdekho.com. Such withdrawal shall take effect within a reasonable period following receipt and verification of your request. Please note that withdrawal of marketing consent does not affect transactional, account, and operational communications, which are necessary for the continued provision of the Services to active account holders.

4. Cookies and Tracking Technologies

We use cookies, web beacons, pixels, and similar technologies to enhance your experience on the Platform, personalise content, remember your preferences, and analyse usage patterns.

4.1 Types of Cookies

• Strictly Necessary Cookies: Required for the basic functionality of the Platform. These cannot be disabled without affecting your ability to use the Services.
• Functionality Cookies: Used to remember your preferences and customise your experience on the Platform.
• Analytics Cookies: Used to understand how visitors interact with the Platform and to improve its performance.
• Advertising Cookies: Used to deliver interest-based advertisements and measure the effectiveness of campaigns.

Third-party advertising partners may also place cookies on your device when you access the Platform, subject to their own privacy policies. SMS Dekho does not have direct control over third-party cookies.

SMS Dekho does not sell, rent, or trade your Personal Data to third parties for their independent marketing purposes. We may share information in the following limited circumstances:

• Service Providers: We may engage vetted third-party vendors and subcontractors to assist in operating the Platform or delivering the Services, subject to strict data processing agreements.
• Legal Compliance: We may disclose information where required by law, court order, regulatory authority, or to protect the rights, property, or safety of SMS Dekho, its users, or the public.
• Business Transfers: In the event of a merger, acquisition, or transfer of all or substantially all of our assets, Personal Data may be transferred as part of that transaction.
• Consent: We may share information with third parties where you have given your explicit prior consent.

6. Data Controller and Processor Roles

SMS Dekho does not own, control, or oversee Client Data stored or processed by a Client or User through the Services. In respect of such Client Data, SMS Dekho acts solely as a data processor on behalf of the Client (who acts as data controller) and processes such data only on documented instructions from the Client.

With respect to information it independently collects from Visitors and Users, SMS Dekho acts as a data controller and is responsible for determining the purposes and means of processing such data in accordance with this Policy.

7. Data Retention

We retain Personal Data only for as long as necessary to fulfil the purposes for which it was collected, or as required by applicable law. Our standard retention periods are as follows:

• Active account data: Retained for the duration of the account relationship.
• Closed account data: Deleted within six (6) months from the date of account closure.
• System backups: Retained for a maximum of two (2) months.
• Legal and transactional records: Retained for a period of five (5) years in compliance with applicable law.

8. Data Security

SMS Dekho employs commercially reasonable technical and organisational measures to protect your Personal Data against unauthorised access, alteration, disclosure, or destruction. These measures include access controls, encryption where applicable, and regular security assessments.

However, no method of transmission over the internet or electronic storage is entirely secure. Please note that SMS messages are transmitted unencrypted and may be subject to interception. We therefore recommend that sensitive information be communicated via more secure channels. SMS Dekho shall not be liable for any security breach that is beyond our reasonable control.

9. International Data Transfers

The Services may be hosted in India, the United States, Germany, or other jurisdictions. If you access the Services from regions with data protection laws that differ from those in India — including the European Economic Area — you acknowledge that your Personal Data may be transferred to and processed in countries that may not offer the same level of data protection as your home jurisdiction. We take appropriate safeguards to ensure such transfers comply with applicable law, including the adoption of standard contractual clauses where required.

10. Fair Information Practices

In the event of a data breach that affects your Personal Data, SMS Dekho will notify you via email or in-Platform notification within seven (7) business days of becoming aware of the breach, to the extent required by law. We are committed to the principle of individual redress and acknowledge that individuals have the right to pursue enforceable remedies against data handlers that fail to comply with applicable privacy law.

11. Your Privacy Rights

Subject to applicable law, you may have the following rights with respect to your Personal Data:

• Right of access: to request a copy of the Personal Data we hold about you.
• Right to rectification: to request correction of inaccurate or incomplete data.
• Right to erasure: to request deletion of your Personal Data, subject to our legal retention obligations.
